The Maltese Revenue has clarified that any premium adjustments dealt with by way of endorsement could be subject to additional stamp duty, even if the endorsement leads to a returned premium.  No refund of stamp duty previously paid is allowed, unless the returned premium occurs before the inception date or within the cooling off period.
 
Endorsements which lead to additional premium are generally subject to stamp duty as a new policy, but stamp duty is due only on the difference between the new and the original policy.  It is understood the minimum contribution rule is applied using the whole of the premium, however.
 
There is a charge of €2.33 stamp duty for certain policy endorsements, and this rate has not increased from 1 February.
